Rock actor, Tracy Morgan stated Tuesday that it was unbelievable for Wal-Mart to partly blame him and others for the damages & injuries and in their involvement of the highway mishap at N.J. Turnpike that caused the death of his friend.

The star comedian released the statement through his publicist that he was accused of Wal-Mart as the cause of the accident that was caused by the blunder of their truck. He stressed that he and his friends were doing not doing anything wrong.

Tracy Morgan and his group were in a limousine that was rear-ended by a Wal-Mart truck as they were traveling along a highway last June. Wal-mart partly blamed him and his party for their injuries because they were not wearing seatbelts; this was the claim of the company after filing a suit in court last Monday.

The suit was filed in the Feds court as an answer to the prior lawsuit filed by Morgan in July for the accident that killed his friend James McNair. They were returning after a performance in Delaware. Morgan was critically injured and spent several weeks in rehab for rib and leg injuries.

According to court record, Morgan who gained fame for Saturday Night Live & popularity as a 30 Rock star was returning from a show in Delaware last June when a truck from Wal-Mart truck crashed the rear of a limo van he and others were riding in. His friend James McNair died and all of them were injured.

Morgan sustained critical leg and rib injuries that he spent the next month in rehab in a hospital in New Jersey.

Morgan said that every day is a hard battle for him to return to his work and he thanked his fans for sticking with him during that difficult time.

The defense counsel of the actor and comedian said that Morgan is having a hard time recuperating from the June mishap that occurred on the Turnpike of New Jersey leaving one of his friends dead.

Morgan sued Wal-mart for the crash but Wal-Mart Stores Inc., based in Bentonville, Arkansas that Wal-Mart in response also filed a court case last Monday partly blamed Morgan and party for causing their injuries as they failed to wear seatbelts.

Kevin Roper, of Jonesboro, Georgia who was the truck operator gave a not guilty plea to charges of death and assault by vehicle in a N. J. court. He was also accused of not sleeping for more than 24 hours before the crash that violated the N.J. law.

Federal transportation safety investigators reported that Roper was driving at a speed of 65 mph before he rear-ended the limousine. The speed limit on that stretch of the turnpike is only 55 mph and later lowered to 45 mph that night because of construction.

Wal-mart added that it has encouraged discussion to a settlement and added their sympathies and condolences to the families and friends of everyone involved.
